New Utah Law Mandates Helmets for E-Bike Riders Under 21

With HB381 officially in effect as of May 6, law enforcement statewide is increasing focus on electric bike and scooter riders to ensure compliance on public roads. Public safety campaigns emphasize that safety is a shared responsibility, urging residents to ride smart, ride legal, and protect themselves and others. Authorities are also highlighting the state's impairment law, making it strictly illegal to operate any e-device while impaired.

Classifications and Requirements
The legislation establishes specific safety standards based on vehicle classification:

• Electric Bikes: Defined as having a motor of 750 watts or less, a factory-installed crank system, and fully operable pedals.
• Electric Motorcycles: Defined as any device with a motor over 750 watts or capable of speeds exceeding 20 MPH without pedaling. Because of their higher speeds and power, riders may be required to carry proof of insurance, a valid driver's license, and a motorcycle endorsement.

Age Restrictions and Enforcement
HB381 implements strict age boundaries and helmet mandates for operating electric mobility devices:

• Under 8 Years Old: Strictly prohibited from operating any e-bike or motorized e-mobility device with the electric motor engaged on public property, highways, paths, or sidewalks.
• Ages 8 to 15 (Effective May 5, 2027): Not permitted to operate these devices on public roads independently unless they complete a state-approved online safety education course and obtain a personal electric vehicle safety certificate. Without this certificate, they may only ride under the direct supervision of a parent, guardian, or responsible adult.
• Under 16 Years Old: Prohibited from operating a Class 3 e-bike (pedal-assist models capable of speeds up to 28 mph) or high-powered e-motorcycles on public roads.
• Under 18 Years Old: If a minor commits a traffic violation while operating an e-mobility device, law enforcement can temporarily impound the vehicle. The impounded device will only be released to the minor's parent or legal guardian.
• Under 21 Years Old: Required to wear a properly fitted and fastened helmet on Utah's public roads (this requirement does not apply to shared paths, trails, or local bike-share networks). Helmet standards depend on the vehicle:
  • E-Bike Riders: Must wear a CPSC-approved helmet.
  • E-Motorcycle Riders: Must wear a DOT-approved helmet.
